Family Seeking $9 Million in Honolulu Military Hospital Lawsuit

The Whitney family of Virginia is currently involved in litigation with a Hawaii military hospital for the birth injuries their son sustained in 2010. Though the court has approved a $9 million settlement, the family and their legal representative are still preparing for a trial as the settlement is still in need of approval by the Department of Justice.

The case has reached this point of approval once before, only to have the Department of Justice deny the settlement. The terms of the settlement include $5 million cash for immediate expenses and suffering involved with the traumatic birth of the couple’s son as well as $4 million throughout the life of the baby.

The parents of the child born with cerebral palsy include negligent treatment by attending physicians during the birth of their son in their list of complaints. The cited problems include: failing to respond to signs of a uterine rupture, taking an inappropriate amount of time to execute a cesarean section, and failing to consult the obstetrician before birth.

Ohio to pay millions for birth injury lawsuit settlement

The State of Ohio is paying millions to settle a lawsuit filed by a woman who claimed she did not get proper medical care while pregnant inside a correction facility, causing her to deliver a baby with cerebral palsy.

According to an online report published Tuesday, March 11, Marcquietta Nored accused the Department of Rehabilitation and Correction of not giving her proper prenatal care while imprisoned at the Ohio Reformatory for Women. She said in her lawsuit that the staff fell short in informing her that she was pregnant and that they never treated her hypertension.

The Department of Rehabilitation and Correction has not stated it was guilty, but agreed to pay $2.5 million to settle the case.

The Driscoll Firm files lawsuit against doctor and medical group for birth injuries

The legal team at The Driscoll Firm recently filed a lawsuit on the behalf of Jasmine Gaylor and her mother, Milagro Gaylor, against Abingdon Obstetrics and Gynecology, P.C. and Jay Wayne Lavigne, M.D. The lawsuit alleges that the defendants provided negligent care in delivering Jasmine, resulting in several birth injuries and necessary medical treatments since her birth. Attorneys are asking for damages worth $10 million for medical bills and other expenses to compensate the Gaylor family.

The complaint (Case No. CL 13-2023, In the Circuit Court for the City of Roanoke) states that Dr. Lavigne failed to properly evalute Jasmine’s medical situation when she arrived at the Memorial Hospital Emergency Department on November 7th, 2008 while experiencing extreme pain and contractions every two to three minutes. As per Dr. Lavigne’s advice, nurses simply observed and monitored Milagro’s condition until nurses sought the medical care of another doctor when Milagro’s contractions and pain had continued for several hours. The second doctor found that a placental abruption had occurred. As a result of the placental abruption, Jasmine developed many medical conditions requiring medical intervention.
